Terms of Use

In using Divorce.ie you confirm that you accept these Terms of Use ('Terms'), as revised by us occasionally at our discretion. Divorce.ie may amend the Terms related to the Services from time to time. Amendments will be effective upon Divorce.ie publishing updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

The Services
The Services constitute a technology platform that enables users to access Independent third party providers such as Professional Mediators and Independent Family Law Solicitors. Case Managers are assigned to assist users with this process and the Divorce.ie platform facilitates the user to communicate with Mediators and Solicitors for the purpose of arranging and attaining Mediation sessions and legal advice. Divorce.ie will offer further services as the program is developed. You acknowledge that Divorce.ie does not provide Mediation services or legal advice and that all such services and advices are provided by Independent third party contractors who are not employed by Divorce.ie or any of its affiliates.

You acknowledge and agree that:

  1. The Mediators and Solicitors are neither our employees nor our agents or representatives;
  2. We make no representation or warranty whatsoever as to whether you will find the Mediators and/or Solicitors Services appropriate, beneficial, suitable, pertinent, fitting or appropriate to your needs;
  3. We make no representation or warranty whatsoever as to the willingness or ability of a Mediators or Solicitors to give counsel, guidance or recommendations;
  4. Your relationship relating to the Mediators and Solicitors Services is strictly with the Mediator and Solicitor. We are not involved in any way with the tangible affluence of that relationship or any part of the Mediators and Solicitors Services (whether provided through Divorce.ie or not), and we do not validate and are in no way involved in any of the Mediators and Solicitors Services;
  5. We do not guarantee that the assigned Mediator and/or Solicitor is specifically qualified to provide any specific service nor whether a Mediator and/or Solicitors is categorised correctly or matched correctly to you;
  6. We do not control the quality of the Professional Services;
  7. We do not in any way provide any reference or endorsement whatsoever of any Mediator and/or Solicitor, his or her competency or the efficacy of his or her Services.

Use of Divorce.ie Website
You acknowledge and agree that although Mediators and/or Solicitors services will possibly be accessed through the Divorce.ie platform, we cannot guarantee the use of the Mediators and/or Solicitors Services or the Website itself is fitting and suitable for your needs. Divorce.ie. role is strictly limited to facilitating the communication between you and the Mediator and/or Solicitor and to enable the provision of these Mediators and/or Solicitors Services for one fixed fee. It is up to you to deliberate and choose whether these services are appropriate for you or not. In order to access the service, you must register for and maintain an active Divorce.ie account ('account'). You must be at least 18 years of age to obtain an Account. Account registration requires you to submit to Divorce.ie certain personal information, such as your name, address, location and age. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services or Divorce.ie's termination of these Terms with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times.

Divorce.ie Client Payments
You acknowledge and agree to use only payment means (credit cards or others) which you are fully authorised to use. All debit and credit card payments are processed through Stripe. Divorce.ie do not collect any information on your method of payment (e.g. the debit/credit card you used). You acknowledge and agree that your payment is subject to the Stripe Services Agreement - Ireland ("the Stripe Services Agreement"). By using Divorce.ie, you agree to be bound by the Stripe Services Agreement. Divorce.ie have no liability in contract, tort for any loss or cost experienced or acquired by you arising out of or in connection with your use of Stripe services.

An initial payment is required prior to the commencement of Mediation. Once you have been appointed a Mediator, the Mediator will contact you and your spouse, to arrange an initial appointment. If for any reason you have to cancel an appointment, you must notify the Mediator at least 24 hours prior to the commencement of your consultation. In the event that either spouse fails to attend, without appropriate notice given, an arranged Mediation session, you will be cancelled from the Divorce.ie program and will forfeit your right to receive a refund.

A second payment is payable directly to the Solicitor on completion of the Decree of Divorce. If either spouse terminates the services of the appointed Solicitor prior to completion of the Decree of Divorce then both spouses will be responsible for all legal costs incurred by their appointed Solicitor up to the date of termination.

All advertised prices for our services are subject to change without notice and are not guaranteed, except prices that are accepted by the user on the date of receipt of the first payment. Acceptance of an offer of an advertised price shall be deemed accepted when an initial payment in full is successfully receied by Divorce Services Ireland.

This program does not include any or all works associated with Pension Adjustment Orders. Fees associated with the administration and granting of a Pension Adjustment order should be negotiated separately with your appointed Solicitor.

Data Protection
You acknowledge and consent that when you provide your personal information to a Mediator and/or Solicitors, the Mediator and/or Solicitors is exclusively liable for your information and we shall not be held responsible for the Mediator's and/or Solicitor's handling, utilisation or storing of your personal information. Data and Computer Systems
You acknowledge and agree that Divorce.ie will have no liability of any kind for viruses or other related unsafe elements that may enter your computer by downloading data, software or other materials from Divorce.ie

Disclaimer
Divorce.ie disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms, including the implied warranties or fitness for a particular purpose and non-infringement. In addition, Divorce.ie make no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the services or any services requested through the use of the services, or that the services will be uninterrupted or error-free. Divorce.ie does not guarantee the quality, suitability, safety or ability of third party provides. You agree that the entire risk arising out of your use of the services, and any service requested in connection therewith, remains solely with the user, to the entire extent permitted under applicable law.

Liability
We will not accept responsibility for the Mediator and /or Solicitors Services, which will at all times remain the responsibility of the Mediator and/or Solicitor. We will not be responsible for any activity involving the provision by the Mediator and/or Solicitors or associated services.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish law.

You acknowledge and agree that we are not responsible for the precision, dependability, appropriateness or comprehensiveness of the profile information of any Mediator and/or Solicitor, any personal data provided by you to a Mediator and/or Solicitors or any other data or information provided or received by you through an appointed Mediator and/or Solicitor.

We will not be liable for any of the following losses or damage (whether known, foreseeable, foreseen): loss of contracts; loss of business; loss of opportunity; loss of goodwill; loss of the use of money; loss of anticipated savings; loss of reputation; loss of revenue; loss of actual or anticipated profits; loss of, damage to or corruption of data.

Indemnity
You agree to indemnify and hold Divorce.ie and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Divorce.ie's use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers.
