It is important to note that the recent Family Law Act 2019 provides a new definition of 'living apart'. It now means that spouses who live in the same home, are considered to be living apart if the spouses are not living together as a couple in an intimate and committed relationship.
Under the new act, a couple must also be 'living apart' from one another for at least 2 out of the previous 3 years before they qualify for a Divorce.
